1. Promoter Details
The promoter is Swim Shady (ABN 97 671 815 017), based in Sydney, Australia.
2. Eligibility
a. Entry is open to Australian residents aged 18 years or older.
b. Employees of Swim Shady and their immediate family members are not eligible to enter.
c. Participants must own The Swim Shady to enter the competition.
3. Entry Period
The competition opens at Friday, 6 December 2024, 10:00 AM (AEDT) and closes at Friday, 28 February, 2025, 11:59 PM (AEDT). Entries received outside of this period will not be considered.
4. How to Enter
To enter, participants must:
a. Post a video or photo to Instagram showcasing their Swim Shady in the most creative way possible.
b. Tag @SwimShadyHQ and your beach location in the post.
c. Use the hashtag “#SwimShady5k”.
d. Ensure your Instagram profile is set to Public at the time of the draw so that the judges can see your entry.
5. Judging Criteria
Entries will be judged based on creativity, originality, and relevance to Swim Shady’s brand values.
The judging panel will consist of Swim Shady representatives.
6. Winner Selection
a. The winner will be selected on Saturday, 1 March 2025, and contacted via Instagram Direct Message from the official Swim Shady Instagram account within 7 days of the closing date.
b. The winner must respond within 7 days to claim their prize. If unclaimed, the prize will be awarded to the runner-up.
c. The winner’s name will be announced on Swim Shady’s Instagram account.
d. In addition to the grand prize winner, five runners-up will each receive a $100 Swim Shady voucher. These winners will be selected based on the same judging criteria and contacted via Instagram Direct Message from the official Swim Shady Instagram account within 7 days of the closing date.
7. Prize Details
a. The grand prize is $5,000 AUD cash, payable via bank transfer into an Australian bank account.
b. Five secondary prizes of $100 Swim Shady vouchers will be awarded to the runners-up.
c. All prizes are non-transferable and non-exchangeable.
8. Consent and Use of Content
a. By entering, participants grant Swim Shady a non-exclusive, royalty-free, worldwide, and perpetual license to use, reproduce, and distribute their submitted content for marketing and promotional purposes.
b. Participants acknowledge that Instagram is not involved in or responsible for the competition.
9. Privacy
Swim Shady will handle personal information provided by participants in accordance with its Privacy Policy, available at Privacy policy – Swim Shady.
10. Instagram Disclaimer
a. This competition is in no way sponsored, endorsed, administered by, or associated with Instagram.
b. By entering, participants release Instagram from all responsibility regarding the competition.
11. Legal Compliance
a. This competition is conducted in accordance with the Community Gaming Act 2018 (NSW) and the Australian Consumer Law.
b. No permit is required for this competition as it is a game of skill and not chance.
12. General
a. Swim Shady reserves the right to amend these terms and conditions at any time without prior notice.
b. Any entries deemed inappropriate, offensive, or not in line with Swim Shady’s values will be disqualified.
13. Liability
To the extent permitted by law, Swim Shady is not responsible for any loss or damage incurred in connection with the competition, including but not limited to technical failures, delays, or entry misdirection.
